What is a pool safety certificate?
A pool safety certificate is an official document that confirms a swimming pool or spa complies with Queensland’s pool safety regulations. These regulations are designed to prevent drowning and injuries, especially for young children.
At Advance Pool Safety, we conduct thorough inspections to ensure your pool area meets all legal requirements before issuing a certificate. If your pool is compliant, we will issue a Form 23 – Pool Safety Certificate, which confirms your pool meets the current safety standards set by the Queensland Building and Construction Commission (QBCC).
When is a pool safety certificate required?
A pool safety certificate is legally required in Queensland when:
- Selling a property with a pool
- Leasing a property with a pool
- Buying a property without a valid pool safety certificate (the buyer must obtain one within 90 days)
If you are selling a property and don’t have a pool safety certificate, you must provide a Form 36 – Notice of No Pool Safety Certificate to the buyer. Advance Pool Safety helps property owners obtain the required certification quickly and efficiently, ensuring a smooth transaction.
How long is a pool safety certificate valid?
The validity of a pool safety certificate depends on whether it is a shared pool or non-shared pool:
- Private residential pools (non-shared): Valid for 2 years
- Apartment complexes, hotels, resorts (shared pools): Valid for 1 year
Even if your certificate is still valid, Advance Pool Safety recommends regular self-checks to ensure your pool remains compliant.
What are the basic requirements for a compliant pool fence?
- Minimum height: 1200mm (1.2m)
- Maximum gap underneath fence: 100mm
- Gates must be self-closing and self-latching
- No climbable objects within 900mm of the fence
- CPR sign must be visible from the pool area
We can provide any advice and suggestions to ensure your pool is compliant.
How much does a pool safety certificate cost?
For residential properties (non-shared pools) it’s $150 for a full safety inspection and $44.26 for the certificate (Form 23).
For shared pools, the full inspection is $200 and the certificate is $44.26.
If minor repairs are needed to get your pool compliant we can often complete this work onsite with no cost, except materials. This can save you from having to book in a re-inspection.
A re-inspection is $120 for all pool types (shared and non-shared)
Who can issue a pool safety certificate?
Only licensed pool safety inspectors accredited by the Queensland Building and Construction Commission (QBCC) can issue a pool safety certificate.
Advance Pool Safety is a fully licensed and experienced pool safety inspection service, ensuring your pool meets all legal requirements. We provide comprehensive assessments, clear explanations of safety standards, and expert guidance if modifications are needed.
What does a pool safety inspection involve?
During an Advance Pool Safety inspection, we thoroughly check:
- Pool fencing: Height, gaps, climbability, and stability
- Gates and latches: Self-closing and self-latching mechanisms
- CPR signage: Correct positioning and readability
- Non-climbable zones: Ensuring objects or structures near the fence do not provide climbing access
- Barrier conditions: No damage, rust, or deterioration affecting compliance
If your pool meets all standards, we issue the pool safety certificate immediately. If not, we provide a detailed report and recommendations to help you achieve compliance.
What happens if my pool doesn’t comply during the inspection?
If your pool doesn’t meet safety standards, we will issue a Non-Conformity Notice (Form 26), which outlines the required changes. You will have up to 90 days to rectify the issues before a re-inspection.
Advance Pool Safety provides detailed guidance on the best way to fix non-compliant areas, ensuring you pass the next inspection.
Can I sell my property without a pool safety certificate?
Yes, but you must provide the buyer with a Form 36 – Notice of No Pool Safety Certificate before signing the contract. The buyer will then have 90 days after settlement to obtain the certificate.
However, many buyers prefer to purchase a home with a valid certificate in place. Advance Pool Safety helps sellers avoid potential issues by conducting prompt inspections and issuing certificates where possible.
Are there penalties for not complying with pool safety laws?
Yes, failing to comply with Queensland’s pool safety laws can result in fines and penalties, which may range from hundreds to thousands of dollars. Local councils and QBCC inspectors conduct random audits, so it’s crucial to stay compliant.
Advance Pool Safety helps homeowners, landlords, and property managers avoid fines by ensuring their pools meet all legal requirements.
Do portable pools require a pool safety certificate?
Yes, if they can hold 300mm (30cm) or more of water, they must comply with Queensland’s pool safety laws. This includes:
- Inflatable pools
- Temporary above-ground pools
- Some large children’s paddling pools
If your portable pool requires fencing, Advance Pool Safety can assess and certify your setup.
Are spas subject to pool safety laws?
Yes, any spa that can hold more than 300mm of water must meet Queensland’s pool safety standards, including a compliant barrier.
Advance Pool Safety inspects spas and swim spas to ensure they meet legal requirements, including lockable covers (where applicable).
How do I register my pool?
All pools must be registered with the QBCC’s Pool Safety Register. Advance Pool Safety can assist with registration if needed.
Is a pool safety certificate required for rental properties?
Yes, landlords must ensure their rental property has a valid pool safety certificate before tenants move in. Advance Pool Safety works with property managers and landlords to ensure ongoing compliance.
What is a Form 26 – Non-Conformity Notice?
A Form 26 is a notice issued when a pool fails to meet safety standards. It lists all necessary fixes to obtain certification.
Can I perform minor repairs to my pool fence myself?
Yes, but any work must meet safety standards. Advance Pool Safety can assess your repairs before certification.
How can I prepare for a pool safety inspection?
Use Advance Pool Safety’s pre-inspection checklist, which covers fencing, gates, CPR signage, and climbability hazards.
